Welcome to Crescent Tracking, a cryptocurrency portfolio tracking application. This application is operated by Crescent, LLC. These Terms and Conditions outline the rules and regulations for the use of Crescent Tracking, located at https://crescenttracking.com. By accessing this application, you agree to be bound by these Terms and Conditions. Do not continue to use Crescent Tracking if you do not agree to all of the terms and conditions stated on this page.

These Terms apply to all visitors, users, and others who access or use the application. By accessing or using Crescent Tracking, you agree to be bound by these Terms. Account Creation and Sign-In

Users can create an account on Crescent Tracking using their email address. Additionally, Crescent Tracking offers the convenience of signing in through OAuth integration, allowing users to connect their Google account or X account. We do not require usernames or phone numbers for account creation or access.

Account Security

As a user of Crescent Tracking, you are responsible for maintaining the confidentiality and security of your account. This includes safeguarding your password and other login credentials. We encourage you to use "strong" passwords (passwords that use a combination of upper and lower case letters, numbers, and symbols) with your account.

Account Misuse

In the event of any unauthorized use of your account or other security breaches, you must notify Crescent, LLC immediately. If we detect misuse of accounts or suspicious activities, we reserve the right to lock or remove these accounts from our platform. In severe cases of violation, we may also resort to blacklisting IP addresses to protect our service and users.

Termination and Suspension of Accounts

Crescent, LLC may terminate or suspend your account if there is evidence of fraudulent activity, malicious intent, or attempts to disrupt our services by intentionally overloading our servers with excessive requests. We take these actions to maintain the integrity and security of Crescent Tracking and our user community.

Account Information Accuracy

You are responsible for ensuring that the information in your account, including your email address, is kept up-to-date and accurate. Accurate information is crucial for account recovery and communication purposes. Failure to maintain accurate information may limit our ability to assist you with account-related issues.

Permitted Use

Crescent Tracking is designed for personal use, specifically to assist users in tracking and managing their cryptocurrency portfolios. Users are encouraged to utilize our platform to monitor their investments and make informed decisions based on the data and tools provided.

Prohibited Use

While we aim to offer a flexible and user-friendly experience, certain uses of Crescent Tracking are prohibited. Users must not employ the application for any malicious activities, such as attempting unauthorized access to our systems or data, distributing malware or harmful code, or engaging in activities that disrupt or negatively impact the application's performance and user experience. Any use of Crescent Tracking that violates local, state, or federal law is strictly forbidden.

Modification and Management of Data

Users have the freedom to create, modify, export, and share their data within Crescent Tracking, adhering to the applicable US data regulations. It is the user's responsibility to ensure the accuracy and legality of the data they input and share through the application. While we facilitate data management, we hold no responsibility for the data's content or any consequences of its use.

User Interactions

Crescent Tracking does not include features for user-to-user interaction, such as messaging or commenting. The application is solely focused on providing personal portfolio tracking services.

Updates and Maintenance

The web application version of Crescent Tracking receives automatic updates. These updates ensure that users have access to the latest features, security enhancements, and overall improvements. We strive to minimize disruptions and maintain a seamless user experience; however, occasional maintenance periods may be necessary.

Part 4: Intellectual Property Rights

Ownership of Application Content

The content within Crescent Tracking, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and the software itself, is the property of Crescent, LLC, or is used under appropriate licenses. This includes commercially licensed icons from IconScout.com and an enterprise license of the Minimal UI from minimals.cc. Users must respect these intellectual property rights and may not use any of these materials outside the scope of normal application use without express permission from Crescent, LLC or the respective intellectual property holders.

User-Generated Content

Any data generated by users, such as portfolio information, is owned by the user. However, Crescent, LLC reserves the right to use this data for various purposes, including but not limited to market research or analysis. It is our policy to ensure that such data cannot be linked to personal identifiable information (PII) of the user, maintaining user privacy even when the data is utilized for third-party research or other purposes.

Copyright Policy

Crescent Tracking does not currently host user-generated content that is subject to copyright infringement claims, as the primary user-generated content consists of portfolio data. However, we commit to respecting intellectual property rights and encourage users to do the same.

Content Use License

Users are permitted to share content from Crescent Tracking, provided it is related to the application and not misrepresented as their own. Any use of Crescent Tracking's assets or content as if it were the user's own, especially for personal gain or misrepresentation, is strictly prohibited.

Restrictions on Content Use

Crescent Tracking's content is intended for use within the application only. We do not provide resources or content for use outside of our platform, and therefore, there are no specific restrictions on external use, as such use is generally not permitted.

Service may be subject to limitations, delays, and other issues inherent in the use of internet applications and electronic communications. Crescent Tracking aims to meet market average standards for uptime but offers no guarantees in this regard.

Accuracy of Information

The cryptocurrency data provided in Crescent Tracking is sourced from a trusted third party, CoinGecko. While we strive to present accurate and timely information, we cannot guarantee that the data will always be perfectly accurate or in sync. The portfolio estimations provided by Crescent Tracking are estimates and should not be solely relied upon for making cryptocurrency trades. Users should acknowledge that cryptocurrency markets are volatile and data discrepancies are expected.

Limitation of Liability

Crescent, LLC limits its liability for data inaccuracies, service interruptions, or any potential damages arising from the use of Crescent Tracking. Our application relies on data from CoinGecko and the availability of Azure hosting services. As a result, Crescent Tracking is not liable for decisions made based on delayed or inaccurate data provided through the app. In cases of extended service downtimes, users may request a refund for the affected billing cycle, subject to our refund policy.

Indemnification

Users agree to indemnify and hold harmless Crescent, LLC and its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of Crescent Tracking, your violation of these Terms and Conditions, or your violation of any rights of another.

Part 7: Modification of Terms

Authority to Modify Terms

Crescent, LLC reserves the right to modify these Terms and Conditions at any time. Our commitment to improving Crescent Tracking means that we continuously evolve our features and policies. As part of this process, it is sometimes necessary to update our terms to accurately reflect our services and practices.

Notification of Changes

Users will be notified of any significant changes to these Terms and Conditions via email. It is important that users keep their contact information, particularly their email address, up to date in our records to ensure they receive these notifications.

Acceptance of Modified Terms

Upon any changes to these Terms and Conditions, affected users will be required to accept the revised terms to continue using Crescent Tracking. This acceptance may be facilitated through an in-app notification requiring users to review and agree to the new terms before further use of the application. If a user does not agree to the new terms, they may discontinue using Crescent Tracking. Continued use after the changes will constitute acceptance of the new terms.

Part 8: Termination

User-Initiated Termination

Users who wish to terminate their account with Crescent Tracking can do so at any time. This can be achieved through the 'Delete Account' option available in the Account Settings within the application. By selecting this option, users can initiate the process of permanently closing their account.

Provider-Initiated Termination

Crescent, LLC reserves the right to terminate a user’s access to the application if they are found to be in violation of our Terms and Conditions. Such termination may be enacted at Crescent, LLC's discretion and without prior notice, particularly in cases of serious or repeated violations.

Effect of Termination

Upon termination of an account, either by the user or by Crescent, LLC, all information associated with the user's account will be permanently removed. Crescent Tracking does not retain any user data once an account is terminated. It is the responsibility of the user to ensure that any necessary data is backed up or exported prior to account deletion.

Post-Termination Rights

Crescent, LLC does not retain any rights to user data after an account is terminated. Once an account is closed and the data is deleted, it is irretrievable and permanently erased from our systems.

Part 9: Cancellations and Amendments

Cancellation Policy

At Crescent Tracking, subscriptions purchased are immediately active and continue until the end of the selected subscription period. If a user decides to cancel their subscription, the service will remain active until the end of the current subscription term. After this period, the subscription will not renew.

Amendments to Services

Currently, Crescent Tracking does not offer the option for users to amend their subscriptions or services once purchased. Users are encouraged to carefully review their subscription choices before purchasing.

Refunds

Refunds are subject to the discretion of Crescent, LLC. Users may request a refund, however, Crescent, LLC reserves the right to either deny or accept this request based on the circumstances of each individual case. We strive to ensure fairness and satisfaction in our refund decisions.

Notification of Changes in Service

Users who are subscribed to receive promotional and product update emails will be informed of any significant changes in services via email. Additionally, all users will be notified of any updates or changes upon their first access to the application following the update. This ensures that all users are kept informed of the latest developments and changes in our services.
